Privacy Policy

Effective September 1, 2026 Last updated September 1, 2026

DealerMoMo is a brand and service of Heart Beat Labs, LLC (collectively, “DealerMoMo,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit DealerMoMo.com, use DealerMoMo software, communications tools, training, support, or related services (collectively, the “Services”), or otherwise interact with us.

This Privacy Policy applies to dealership personnel, prospective customers, website visitors, vendors, and individuals whose vehicle listings or communications are processed through the Services. It does not apply to information governed by a separate written agreement that expressly supersedes this Privacy Policy.

Section 01DealerMoMo’s Role

DealerMoMo helps automotive dealerships identify potential private-party vehicle acquisition opportunities, organize publicly available vehicle-listing information, manage outreach workflows, communicate with vehicle owners, and improve dealership acquisition activity.

When a dealership uses the Services to process information about a vehicle owner or seller, the dealership generally determines why and how that information is used. In that context, the dealership is the business or data controller and DealerMoMo acts as its service provider or data processor. Questions about a dealership’s use of your information should be directed to that dealership. DealerMoMo may also use limited information for its own business purposes as described below.

Section 02Information We Collect

The information we collect depends on how you interact with the Services.

A. Account and dealership information

We may collect:

  • Name, business email address, business telephone number, job title, dealership, dealer group, store location, and department;
  • Username, password or authentication information, account permissions, and user preferences;
  • Subscription, order-form, billing, and transaction information; and
  • Training participation, support requests, survey responses, and other information you provide to us.

Payment-card information may be collected and processed by our payment processor. DealerMoMo does not intend to store complete payment-card numbers on its own systems.

B. Vehicle, listing, and seller information

We may collect information contained in private-party vehicle listings or provided during acquisition communications, including:

  • Seller name, username, profile information, email address, telephone number, and general location;
  • Vehicle year, make, model, trim, VIN, mileage, condition, features, photographs, asking price, listing history, title or lien information, and other vehicle details;
  • The source and URL of a listing, timestamps, status, and marketplace-related information; and
  • Notes, appraisals, estimates, offers, appointment details, disposition, and acquisition results entered by dealership users.

This information may come from dealership users, vehicle owners, public vehicle listings, publicly available sources, permitted marketplace or data-provider feeds, and service providers.

C. Communications and content

We may collect and process:

  • Emails, text messages, call-related records, direct-message content, message templates, attachments, and communications between dealership users and vehicle owners when transmitted through or entered into the Services;
  • Communication metadata such as sender, recipient, date, time, delivery status, response status, opt-out status, and engagement history;
  • Prompts, instructions, files, and outputs associated with AI-assisted features; and
  • Customer-service and training communications with DealerMoMo.

Depending on the feature and applicable law, calls may be recorded or transcribed only after required notice or consent has been provided. Dealership customers are responsible for configuring and using communications features in compliance with applicable law.

D. Device, usage, and website information

We may automatically collect:

  • IP address, browser type, device type, operating system, approximate location derived from IP address, and device identifiers;
  • Pages viewed, links clicked, referring pages, dates and times of access, session information, errors, and feature usage;
  • Login, audit, security, and activity records; and
  • Information collected through cookies, pixels, local storage, software development kits, and similar technologies.

E. Information from integrations and third parties

If a dealership connects DealerMoMo with another service, we may receive information made available through that integration, such as CRM records, user identifiers, vehicle records, communications, and activity data. We may also receive business contact information from referral partners, vendors, public sources, and other lawful sources.

Section 03How We Use Information

We may use personal information to:

  • Provide, configure, maintain, secure, and improve the Services;
  • Authenticate users and administer accounts and permissions;
  • Identify, organize, and prioritize potential vehicle-acquisition opportunities;
  • Enable dealership outreach, communications, follow-up, opt-out management, and workflow tracking;
  • Generate message suggestions, explanatory content, summaries, analytics, performance reports, and other AI-assisted outputs;
  • Deliver training, onboarding, customer support, billing, and account management;
  • Detect fraud, misuse, security incidents, prohibited activity, and technical problems;
  • Enforce our agreements and protect our rights, users, customers, and the public;
  • Comply with law, legal process, and regulatory obligations;
  • Communicate about the Services, including administrative notices, updates, and marketing where permitted by law; and
  • Create aggregated or de-identified information that cannot reasonably be used to identify an individual.

DealerMoMo does not use vehicle-listing or communications data to make decisions that produce legal or similarly significant effects concerning consumers. AI-assisted features are intended to support dealership personnel, who remain responsible for reviewing outputs and making decisions.

Section 04How We Disclose Information

We may disclose personal information to:

A. Dealership customers and authorized users

Information may be available to the dealership or dealer group that uses the Services, its authorized personnel, and other users acting under its direction.

B. Service providers and subprocessors

We may disclose information to vendors that provide cloud hosting, data storage, security, analytics, authentication, communications, AI processing, customer support, billing, payment processing, and other services. These providers may process information only for the purposes for which we engage them, subject to contractual restrictions where required.

C. Integrations and third-party services

At a customer’s direction, we may transmit information to CRMs, communications providers, valuation services, marketplaces, dealer systems, or other integrations. The third party’s own privacy policy applies to its processing.

D. Legal, safety, and compliance recipients

We may disclose information when we reasonably believe disclosure is required by law or legal process, necessary to protect rights or safety, needed to investigate fraud or misuse, or appropriate to enforce our agreements.

E. Business transfers

We may disclose information in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar corporate transaction, subject to applicable law.

F. With consent or at your direction

We may disclose information for another purpose when an authorized user or affected individual directs us to do so or provides consent.

We may disclose aggregated or de-identified information for any lawful purpose. We do not sell personal information for money. If our use of advertising or analytics technologies is considered a “sale,” “sharing,” or targeted advertising under applicable state law, you may exercise the applicable opt-out right as described below.

Section 05Cookies and Similar Technologies

We may use essential cookies to operate and secure the Services and optional analytics or functionality cookies to understand usage and improve performance. Where required, we will request consent before using nonessential cookies. Browser settings may allow you to block or delete cookies, although some Service features may not function properly.

Where required by applicable law and technically supported, we will treat a recognized Global Privacy Control signal as a request to opt out of sale, sharing, or targeted advertising for the browser or device sending the signal.

Section 06Communications, Consent, and Opt-Outs

Dealerships using DealerMoMo are responsible for ensuring they have a lawful basis and any required consent before calling, texting, emailing, or directly messaging a vehicle owner. The fact that information appears in a public listing does not by itself establish consent for every form of communication.

If you receive a message from a dealership through DealerMoMo, follow the instructions in that message to opt out, such as replying STOP to a text message or using an email unsubscribe link. You may also contact the dealership directly. DealerMoMo may maintain suppression records so that opt-out requests can be honored.

To stop DealerMoMo marketing emails, use the unsubscribe link in the email. We may still send nonmarketing messages concerning an account, transaction, security matter, or legal notice.

Section 07Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Privacy Policy, comply with customer instructions and contractual commitments, resolve disputes, maintain suppression and audit records, enforce agreements, and meet legal obligations. Retention periods vary based on the nature of the information, the customer relationship, legal requirements, and security considerations.

When information is no longer required, we may delete, de-identify, or aggregate it. Backup copies may remain for a limited period before being overwritten or deleted through our ordinary processes.

Section 08Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. These measures may include access controls, authentication, logging, encryption in transit, vendor oversight, and security monitoring. No system or transmission method is completely secure, and we cannot guarantee absolute security.

Authorized users are responsible for maintaining the confidentiality of their credentials and promptly notifying us of suspected unauthorized access.

Section 09Your Privacy Rights

Depending on where you live and subject to legal exceptions, you may have the right to:

  • Confirm whether we process your personal information;
  • Access or obtain a copy of personal information;
  • Correct inaccurate personal information;
  • Delete personal information;
  • Obtain certain information in a portable format;
  • Opt out of the sale or sharing of personal information, targeted advertising, or certain profiling;
  • Limit certain uses or disclosures of sensitive personal information; and
  • Appeal a decision concerning a privacy request.

We will not discriminate against you for exercising an applicable privacy right.

Authorized agents may submit requests where permitted by law, but we may require proof of authorization and identity verification.

If DealerMoMo processes your information solely for a dealership customer, we may refer the request to that dealership or ask you to contact it directly.
